The Nainital High Court has issued a notice to the Uttarakhand and central governments regarding public interest petitions challenging the implementation of the Uniform Civil Code (UCC) in the state. The court has directed both governments to submit their responses within six weeks.

A bench comprising Chief Justice G. Narendra and Justice Ashish Naithani heard three petitions challenging the provisions of the UCC related to Muslim marriage, divorce, iddat, and inheritance. The petitioners argued that the UCC violates the right to religious freedom (Article 25) and the right to privacy (Article 21) under the Indian Constitution.

Solicitor General Tushar Mehta dismissed the petitions as baseless, asserting that the UCC safeguards women`s rights. Meanwhile, the petitioners` counsel argued that civil laws cannot override the provisions of the Quran.

The petitions also challenged the mandatory registration and penal provisions for live-in relationships, as well as the changes made to halala, iddat, and inheritance rights under the UCC.

The court has granted six weeks for the government to submit its response on these issues.
